Child maintenance for 5 yrs old daughter

06-Sep-2023 (In Divorce Law)
Need 2nd opinion - I'm a 31 yrs old woman with a 5 yrs old daughter. Getting divorced on mutual consent. My husband is a govt. employee, earns about 60-70k per month, and only son to my in-laws. 1. I would like to know how much I should claim child maintenance considering the age of my child? I lawyer has asked me to claim for anything between 5-10 lakhs. Do you suggest me to decide something between this range? 2. Also, my in-laws have enough amount of property but right now he doesn't have anything on his name legally apart from the flat that he has purchased. 3. Can I claim for some amount of property later on after 5-10 years? 4. Or instead of child maintenance can I ask him to take care of her complete education expenses? IF yes. Can we put it legally?

Yes you can claim it legally.
1. You can claim maintenance amount as per your living standards..and for your daughter you can claim school expenses, medical expenses if any, for food and clothing, etc.. it's on you what to add... instead of claiming lump sum amount ask monthly payment...and if you want lump sum, calculate school fees of one year, maintenance amount probably of a year, etc.. multiply it with 13 yeras... that may the probable amount..
2. As your daughter is legal heir of her father and his property she can claim after become major....or before her turning 18 you can claim it on behalf of her as a natural guardian.
