Child is 5 years old and I want to stay separately with my baby boy

I don't want to stay with my partner, he is emotionally, physically and mentally detached from me. We stay in separate rooms like a roommate and haven't spoken for 6 months and it is only need to talk basis. How should I proceed without divorce

Dear Madam, There is a provision under Section 10 of Hindu Marriage Act which provides for judicial separation when minds of couple are not meeting. You may file a such case and take an order of judicial separation and stay in the same house with a hope that in near future your husband may change his attitude towards you. If such exercise is not worked out then you can apply for divorce with alimony.

First you proceed with rcr petition under section 9 of HMA if it doesn't work then you can contest a divorce petition on grounds of desertion and mental cruelty as per the sections 13 (1) (a) of HMA Act.
