Dear client if child is willing to stay with you then it is a good point to remain his custody with you. If your husband is showing that he is not working then it is also a good point for you to remain the custoday of your child with you. You should not show that the child is not living with you. It must be shown that the child is in your custody and care. You can prove your case and retain the custody of your child.

In your case you have to show the court with evidences then it was you who is taking care of the child from the very beginning. Evidences may include the school fees receipts and if the physical custody of the child is with you then the overall development of the child is taken care of. For more legal assistance I am just a call away.

dear client as per your query I can only suggest that do not go for wrong fact in your case until required if nothing can be resolved as the affidavits are given by you only so concealment of fact and wrong information about you given by you to the court will give bad impact on your case for future paid consultation please contact us with your relevant documents.
