Child custody of my 4 years daughter

Hi, Me and my wife moved to Bangalore some 6 months back..During the month of may 2021 my wife got a job and said that she wants to marry somone else who helped her with the job and left my home. She said that to take my child with me and she don't want her. I took my 4 year old daughter and moved to my home town. From birth itself my child has always stayed in my home town. Now I am taking care of my daughter.. I want my daughter to be with me.. But my wife have sent a notice from Banglore family court under sec 25 of g and w asking for custody of my daughter.. I belive the jurisdiction for this case will be my home town and not bangalore .. Please correct me and help me..

hi sir, the jurisdiction of child custody case comes where the child resides but not where the wife resides, this case may be dismissed, but need to prove the place she's child resides, kindly contact me for any legal assistance, thanks

Jurisdiction can also be her place of residence, sir. However, you can apply for transfer of case to your jurisdictional court. Have you contested in this matter in Bangalore? You’d have to appear here and then try to have it dismissed/ transferred.
