Child custody Alimony maintenance property right related issues

My wife has file a direct jhutha FIR for physical & Mentally harrasment in August now in October she file a direct case of DV, maintenance, property against me. She also not allowing my child to talk to me. She is her parents home from August. I told him to come back but she not agree.she asking money for child education etc wheather I should give money to her or not. How can I get my child (Girl-7 years) custody. She & here mother is very aggressive & lier lady always trying to fight with me.

you can file case of cruelty against her. if she has put a false dv case can prove by evidence go in for mutual divorce where you can file for settlement of property maintenance child custody by drawing up a petition under section 13 b of the Hindu marriage act

Hello there .. I can completely understand your side.. you just need an advocate to represent you in your concerned District Court. Since the wife has already filed cases you need to submit your written statement through your Advocate.. and do not worry the courts now a days are very alert and will not not be against you unless there are substantially proof.. where is your case filed if I may ask

You can give her some money through bank if she or ur daughter really needs it. later you can file application in on-going case asking to meet ur daughter, court will allow it. as far as the entire case is concerned you can fight the case on merits. For complete information you can contact us.

first, you must file a suit of section 9 of Hindu Marriage act. for the custody of child, you must file a case in guardianship and Ward act. In this case you can claim the custody of the child. if you want immediate relief you can also fine a writ in High Court for visiting rights.
