Case for Maintenance and return of stridhan

In a court case of DV , on last date magistrate ordered to file rejoinder and income expenditure affidavits of both parties within 3 weeks of date of order. nThe deponent's counsel took all documents and said that he filed the documents within 2 days. But, now when the aggrieved checked the file in court there are no affidavits filedMore than 1 month has passed. What should the aggrieved side do now as the advocate is not responding.

Your advocate must have filed the income affidavit because on the basis of your income affidavit only your maintenance and alimony will be decided. Since the time has elapsed you need to file it in the court itself before the mahila magistrate. For more legal assistance I am just a call away.

If your advocate is not responding then kindly change him or her and you can come an application in court for awarding interim maintenance till the main application is decided as the Hon’ble Supreme Court of India has said that application may be decided early and within 60 days interim maintenance may be granted

You need to file the application in the same court n raise this issue before the concerned magistrate …if your advocate is of responding that means you might have not paid his fee, otherwise advocates always respond ..if the case is different then u may look forward to replace your advocate..b in touch
