Can wife take divorce if I dont want divorce

Sir I have got married june last year. After 3 month of my marrieg a married woman lodge a 494 case against me and she also not divorce her husband and still stay with him through a false notary paper in which I signed . After 494 case and I got bail. Now my wife want to stay with me but her parents not allowed and threating me. Can I back my wife legally. Can her father lodge any case against me but my wife fully support me. Kindly suggest thank u

You have full right on your wife. Call her and ask her to come and stay with you. You can take the assistance of the police if required.
Your Father in law has no affairs in the matter, as long as your wife wants to stay with you.
You can also file a petition for Restitution of conjugal right in the family court alleging against your Father in law.

if your wife agreed to stay with you then there is no problem for restitution of your conjugal life as you must have heard " mia bibi raji to kya karega kaji", so if the parents of your wife not allowing your wife to stay under one roof with you then you may approach the Family court for restitution of your conjugal life under section 9 of Hindu marriage Act. Yes, if your wife is willing to stay with you and is being estopped by her father, then you can file a writ of habeas corpus in the high court for getting your wife relieved from such unlawful detention by her father. However, she should be willing to depose before the court that she has been forcefully detained and that she desires to stay with you. If you have her confidence then no power can stop you from being together.
