Can someone file for divorce within one year

Divorce within one year of marriage ad the marriage not yet registered. Still we can go for divorce.

There is a bar of seeking divorce within one year of marriage

But in special circumstances court may with special leave allow litigants to file divorce

Yes, provided there is evidence of marriage having taken place. If both parties agree, a mutual divorce can be obtained easily. The application can be filed at the place where either spouse reside

Yes you can file Divorce Petition within a year before family court. There is no obligation to filing the Divorce petition before court whether it was not registered before the register office.

This is my response to you:
1. No you cannot go for divorce;
2. There is a waiting/cooling off period of one year;
3. You can file for separation by executing an MOU;
4. Engage services of a lawyer and draft the clauses of your separation as per your own terms.
