Can pwdv act section 12 can be quashed under 482 Crpc in High Court?


16-Aug-2024 (In Divorce Law)
My 498a has been quashed in High court of Karnataka. Divorce and maintenance case is also completed and closed. Only Domestic Violence Section 12 case is still running and its with Petitioner to submit assets and liabilities. But the petitioner is not appearing from past 1 year. Can high court quash DV Section 12 case also under 482 CrPC?

yes, domestic violence case can also be quashed in high court. but it depends on the facts of each case. without going through your other three cases and it's final order it is difficult to give any view. however, there is provision for quashing of DV case.

There is no exception to crashing of section 12 of Domestic Violence Act, in your face since petitioner is not appearing in post for the past 1 year you will get a remedy by filing for quashing in thigh Court ..
