hiiii..... I have read ur question now.... as per ur question u cannot file divorce petition on behalf of ur daughter bcoz of this is not the civil matter if this is civil matter u can file matter on behalf of power of attorney..... now here situation is different.... when ur daughter married?? Many questions are arise here so call me for additional information..

Sir, if the divorce you are about to file is of mutual consent between husband and wife then you can file the petition on behalf of your daughter by filling her Power of attorney.

On the other hand, if the husband is against for filing mutual divorce, then the presence of your daughter for filing the divorce petition is must.

In order to file the divorce petition your daughter will need to be present personally. However, after that, once the petition is filed and admitted we you can request the Court for her leave as she is studying abroad.

My First question is your daughter going for mutual consent for divorce or normal divorce. Yes you can file divorce on behalf of your daughter provided she has to give power of attorney to you. She has to come to the court only once when court passes a degree for divorce.
