Can my wife complaint against me in women cell for having an affair

23-May-2023 (In Divorce Law)
Is there any section under which my wife can take me to women cell for having chat with a girl to whom I used to like after marriage. I have no connection with the girl now. I tried to persuade my wife about it. But she left home today saying she will not live with me. Prior to this about one year back..she had filed false dowry case and different other allegation on me. Along with it she filed complaint for harassment in women cell. I made compromise and took her home after giving written assurance to the cell. she actually is not understanding. And now I doubt she is going to reopen the case( no knowledge to me that it was closed or not). She has taken my daughter and i cant live without my daughter. Please help what should I do?

Yes she can complain against you in women cell. Mental cruelty and harassment are the grounds which she can opt for. She can move petition for dowry too. As you said you are not in any affair now and want to save your relationship I personally will suggest you try to gain her trust back though it won't be easy now but as the child is also involved I believe It's always good to compromise or settle the matter amicably if the parties can do so. Thank you.

your wife cannot file any case against you for chatting with a girl but yes our wife can file 498a FIR against you but that will be investigated by the police if there is no evidence you can move to quash the FIR in the concerned High Court

Your wife can file a fresh complaint alleging cruelty & dowry harassment, however since she has given complaints earlier, and withdrawn them, you can always take a stand that in order to harass you, she files complaints, and later withdraws them. In the event your wife doesn't return and /or doesn't allow you to meet your minor daughter, you may have to file a petitioner under guardianship act seeking custody and/or visitation rights of the minor child.
