Can my elder son claim inheritance of my house by force & blackmail?

11-Jun-2023 (In Divorce Law)
I am 58 yr old man who owns a builder flat in south delhi having 2 sons aged 24/21yrs and 51yr old wife whom I wish to apply MCD. Can my elder son who stays out of delhi on job throw me out of my own house and claim inheritance and humilate and blackmail me?? What should I do because they have divided my house and left me alone but want all my money and disgrace me as well. What can I do now?? I can’t stay in this house anymore with them but they just want my money and property ??? I am devastated and have no regular income anymore but have moral support from my younger son (21years old)but he seems helpless and confused.!!! His future will get ruined in this curated drama !!! How can you help and guide to safeguard my honour and respect and my property??

no one can forcibly claim inheritance from you. in fact you may claim maintenance from your elder son if you can show that you are unable to maintain yorself. othr than that you may also seek directions from court for stopping of such harassment to you. you may also consider filing a police case depending on the facts of the case.

sir the question which you raised in that first of all it needs to be seen whether your property is your self acquired property of inherited property or we can say joint hindu family property to ascertain whether your son has a share in it or not. if the property is purchased by you on your own then he cannot ask for any share. further if the property is inherited by you from your father then also he cannot claim anything, but if the property is inherited by you from joint family sources or joint family property then he can claim which is still to some limit.
