Can I stop divorce filed in US by help of Indian court, please advise
27-Jan-2023 (In Divorce Law)
I have been living in USA for 4+ years, and my husband has been living in USA for 20+ years. We both came on student visas, but have now received our Green Cards. We got married in USA 2 years ago. We have not visited India together or separately after getting married. My husband filed for divorce in USA last year (less than one year of marriage) on the grounds that 'marriage is irretrievably broken'. Can I get Indian family courts to stop him from proceeding in the USA divorce proceedings? I am still living in USA.
No you can not file a case against your husband because you and your husband both parties are not living in india and your marriage is not solanine in india.if marriage party any one lived in india.or marriage organization in India than india Court jurisdiction to hearing your matter but both you no your husband live in India.so india Court jurisdiction to stop your divorce case.
Yes u can do this..but first u have to come india and then u can file case against ur husband in sec406&498A ipc & also domestic violence case u can file...u can file a case of mentinense under section 125 crpc..then ur husband will be underpressur.
you have to tell me that whether the marriage is Hindu marriage complying the mandatory requirement of Hindu marriage act,1956. Moreover, if you have accepted notices of the divorce petition filed by your husband and appeared before the court without raising any objection with regard to jurisdiction of the court to try such matter then you cannot , and would be presumed to waive your right to challenge the as u have submitted you to the jurisdiction of the court of USA.
