Can I remarry if my gives me permission to remarry without giving me

Suppose if my wife is separated for 4 years and doesn't want to divorce me and agree that I can remarry another girl without divorce then which form I need as a proof of her statement?

if there is no divorce between both the parties then no one can marry any other one as this is not legal it is against the law you can apply for contested divorce as one party is ready for divorce what is your jurisdiction....

As per your query in law rato only after getting divorce then only you can remarry otherwise it is not possible. Therefore first get a divorce decree then plan for remarriage, then only it is possible.

there cannot be any waiver against statute nor there can be any agreement against a statute. hence unless a formal decree of divorce is obtained from a competent court of law there cannot be any occasion to escape the liability of bigamy irrespective of what your legally married wife might have agreed upon before such offence.

now in India biogamy is not a punishable offence. you can get married but you must inform her abouy the past stories. if she has no problem if you get remarried then why she is not giving divorce to you.
