Dear Sir/Madam, You are not bound to agree to a mutual consent divorce if you do not wish to. A mutual divorce can proceed only when both husband and wife give free consent under Section 13B of the Hindu Marriage Act. If you refuse, he cannot force it. He may, however, file for a contested divorce on certain legal grounds such as cruelty, desertion, etc., which could take 2–5 years depending on the case and court workload.
