Can I Travel Abroad with a Pending Court Case in India?

14-Jun-2024 (In Divorce Law)
My wife has filed a domestic violence case against me. There is also a pending 498A case. I have got Anticipatory Bail (AB) and also regular bail. The charge sheet is submitted, and charges are yet to be framed. The DV case is running, and I am contesting both the cases.

There is no condition or restraining order to go abroad in either the 498A or the DV case. Can I travel abroad with 498a as a tourist for a short-term trip (7 to 10 days)? Will it weaken my case in any way?

By the way, the case is false, and since my beloved wife is super greedy, she has filed these cases only to extract free money, as it appears from the face of the matter. In the domestic violence case, she has also applied to take my passport into custody, but nothing like that has happened. I am contesting the DV case, and my lawyer is appearing on all court dates. Please suggest:
  • Can I leave the country with a pending court case in India?
  • Can a person on bail travel abroad?
  • How can a person go abroad if he has a police case?
  • Is court permission required to travel abroad in criminal cases?

A person accused in a Section 498A case in India can generally travel abroad, but it depends on specific conditions. If there are no travel restrictions in the bail order, no Look Out Circular (LOC), and no explicit court directive preventing travel, the person may leave the country. However, if court permission is required or a restriction exists, they must obtain approval before traveling. Courts consider factors such as the seriousness of the offense, the accused's past conduct, and the purpose of travel when deciding on such requests.

Can a Person Travel Abroad While a Criminal Case is Pending in India?

Whether a person can travel abroad with a pending court case in India depends on various factors like the seriousness of the offense, the stage of the case, and the court?s discretion.

If the person is already on bail or has been released on bond, they may be allowed to go abroad ? but only with the court?s permission. In such cases, the person must file an application to travel abroad, mentioning valid reasons like job-related travel, family emergency, or medical treatment.

The court may allow travel but could also set certain conditions, such as:

  • Surrendering the passport
  • Providing a surety or guarantee
  • Fixing a return date or limiting the travel period

It?s very important to note that if someone leaves the country without court permission while a criminal case is pending, they risk being declared a "proclaimed offender", and legal action can be taken when they return to India.

So, if you're wondering:

  • Can a person on bail travel abroad?
  • How to take permission from the court to go out of the country?
  • Can I go abroad if I have a case?
  • Permission to travel abroad in criminal cases

? the answer is: Yes, but only with prior court approval and by following all legal steps.

Can I Travel Abroad If There Is a Pending Case Against Me in India?

In most cases, unless the court has specifically restrained you from traveling abroad, you are free to travel. The mere filing of a criminal case, such as a 498A case, does not automatically stop you from going abroad unless there is a specific court order saying so.

However, your ability to leave the country with a pending court case in India depends on the conditions of your bail. Sometimes, the bail order may include restrictions on your movement or travel, especially if the court believes there's a risk of you not returning.

No matter what your reason for travel is — tourism, work, family, or medical — your permission to travel depends on:
  • The type of case filed against you
  • The terms of your bail
  • The court’s discretion
  • And whether there is any restriction or order in place
If your bail is conditional and it states that you cannot travel abroad during the pendency of the case, then you must follow that condition strictly. However, if your bail does not restrict travel and there is no court order stopping you, then you are legally free to travel. To be safe, you can also:
  • Apply to the court for permission to travel abroad in criminal cases
  • Mention your reason for travel
  • Provide assurance of your return (like return tickets or surety)

Can I Travel Abroad If There Is No Restraint Order in My Case?

If there is no restraining order preventing you from leaving the country, you can travel abroad for a short period, unless the court has specifically directed your personal appearance in civil cases.

In FIR cases, you may be able to apply for an exemption through your lawyer, allowing you to travel. However, it's important to remember that you should not violate your bail conditions or jump bail, as that can lead to serious legal consequences.

Make sure to consult with your lawyer before making any travel plans to ensure there are no legal restrictions or court orders preventing you from leaving India.

There is no restriction on you traveling abroad for a short duration while your cases are pending. However, you must be present in court if required on the next date of hearing.

To show your diligence and commitment to attending hearings, you can ensure that your appearance is marked in person for the next hearing immediately after you return from abroad.

Ideally, you should apply to the court and seek permission before traveling abroad. However, if your bail is not conditional and there is no restraining order against you, you are free to travel.

It is also important to keep your travel plans discreet. Do not reveal to anyone that you will be traveling, as this information may reach your wife. To avoid any issues, stay off platforms like Facebook and other social media.
