Can I have right over matrimonial property if husband disowned

I am Hindu . My marriage is of 10 yrs .i hv one daughter . I hv matrimonial dispute with my husband.. and i m residing in matrimonial house due to DV act. But this property is on my mother-in in laws name. And she disowned her son ( my husband) on papers. She was filed the civil suit againt me just to through me out of the house And the court had ordered in favour of her. Because of my lawyer's involvement with my husband and in laws . Now its time bar.... Plz suggest me what to do

You can show sufficient cause for the delay and challenge the order. You will have to plead such facts that show that your mother in law disowned your husband just to get you out of the house. In reality she hasn't disowned him. Better opinion and further proceedings in such cases can be given only after knowledge of full facts of the case

First of all you have to answer some questions. Is there any sibling of your husband? How old is yor daughter? What your husband do? How this property purchased by your in laws, you hv rights against your husband but not against your in laws

well u are intitled as a snare holder in the property.it does not mean after disown hence you.have full.right over the prop..sicession act is different from disown now go through the Indian succession act as per the act if some disown his son readon bring marriage then only.pinlicYipn in paper is not sufficient for further information u can contsct

Now stay at home in capacity of daughter-in-law having right to residence, if still your husband is living with your mother in law. Or if he lives separately, go for maintenance of yourself and daughter u/s125 Cr.PC.
