Can i get MOU signed by girls family that they are aware of my divorce

I am legally divorced.now going to marry a single girl who is not divorced. she and her sisters and mom are ready to do marriage and also aware of my divorced. Problem is that her brother and her sisters husband is not aware of this. I asked her to do notary or MOU before marrige that she is aware of all this and she is ready, Can you please advice, Should i proceed with this? should i do marriage with her in spite of her brother is not aware of my divorce?

In this situation, an affidavit is required to be signed by that girl in which it is stated she is aware of the facts that the person to whom she is going to marry is divorcee but as she find him good person hence ready to marry and have to get it notarised with registered number. Hi. As regards your query, you could proceed and definitely get married to this girl if she is over 18 years of age and single in status. Hope this clears your doubts. Legally the opinion of other members does not arise and there is no need for any Mou. But you could do a prenuptial agreement with your to be wife for sake of clarity on certain other issues if you want.

After going through your facts, it is clear that girl is ready to marry you. Girl who has attained age of majority i.e. 18 years old is legally competent to marry with boy who attained age of majority. Her consent for marriage is free and valid in the eyes of law. Nobody can force or prevent her to marry you. You can marry her.

See now when you are planning for a new relationship. It always better to keep things transparent as much as possible. Tomorrow there must not arise any issue. It would be always better if you portray things as they are. You can go for signing of an MOU wherein making the all the members of her family as party to the MOU
