Can I get a divorce if my husband is not ready for it

I am married now its been 8yrs.i need divource we are not even physically or sexually connect with each other. Will i get divource soon. Only with my wish wil i alone can get divource from him if he opposed also. Because i have married to my moms brother. I dont like this Marriage . I dont have any money i am helpless will i get justice

Yes she can get divorce from her husband period of marriage don't matter if she she is being treated with cruelty certainly she can get divorce as you have stated that she is living in church whether she was married in a church then she has to move accordingly but she can get divorce on cruelty so far as cost is concerned it always depends on jn which city you are residing it can vary from city to city e.g. in patiala it can be 30 whereas in Ludhiana it cqn be ten times but make it sure you contact a good person as when ever you met a person you can immediately understand his nature

As the apex court has held that denial of sex by spouse amount to cruelty and unilateral decision or refusal to have intercourse for a considerable period without there being any physical incapacity or valid reason may amount to mental cruelty. “Mental cruelty could cause more injury than physical harm

The first answer the person who wants divorce have a to file a petition of divorce before the competent court of jurisdiction u/s 13 of Hindu marriage act 1955 And further the petitioner can also claim maintenance from husband for livelihood. Most probably maintenance be awarded as soon as possible after that her position would be right and she can fight her case very well
Second answer :-Justice has no cost .

Yes, she can file divorce there is no need to get consent from other party, she can also claim maintenance as she is legally wedded wife. File a divorce on the grounds of cruelty under Hindu marriage act.

Hi... if you both are ready for divorce then go mutual consent coz you can get divorce within the period of six months and if your husband is not ready for divorce then you have to contest the case .
