my wife left my house after 2 days of marriage for pagfera..she never back....and filed for maintenance...from last one year case is running and 2 months before in accident my collarbone got broken..and doctor suggest me bed rest... I'm unable to maintain myself...can now I file Maintanence case against my wife because (1) she was worked as teacher before marriage. (2) 2 years elder than me...(3) she is postgraduate (4) her father was retired from govt job...and (5) Her brother run buisness

Yes u can claim maintenance by filling a divorce case as she has deserted u for nobreason and that comes under mental cruelty .File for divorce including section 24 for ad interim maintenance .Then later on u can claim permanent alimony under section 25 HMA
