Can I file for divorce if my wife has filed a DV act case against me?

Dear Citizen,
You have to file an application u/s 13 of the Hindu Marriage Act (in case you are a hindu). In this you can plead cruelty by wife on account of frivolous and false cases filed against you as a ground to get divorce.

In addition you can also plead other grounds that you find important. Divorce proceedings tend to take time. You can contact your advocate who filed your bail application in 498A matter to file for divorce as well. But you have to keep in mind that you cannot marry during the pendency of divorce proceedings.

In case your wife is ready to withdraw false cases, you can opt for mutual divorce which is most advisable way to end marriage.
