Hi there, dowry case which is filed under S.498A IPC / S. 85-86 of BNS are purely criminal in nature and they can be filed within one year without any problem. If you need any explanation or have anymore questions feel free to contact me.

Yes, it is legally possible, but timing and facts matter. Under Indian law, Section 498A IPC (dowry cruelty) has no fixed limitation period because it is a cognizable and non-compoundable offence. Courts have consistently held that if the acts of cruelty or dowry demand are continuous in nature, a complaint can be filed even after a gap of one year or more. However, delay is not irrelevant. If you have already filed a DV Act case and maintenance proceedings, and you now initiate a 498A case after one year, the accused will almost certainly argue afterthought, malice, or abuse of process. Courts scrutinise such sequencing closely. You must be able to show: • Specific acts of dowry demand/cruelty • That such acts were not fully disclosed earlier, or • That cruelty continued or had lasting consequences The DV Act has a one-year limitation from the last incident, but courts allow flexibility if the violence is continuing. Maintenance proceedings do not bar a 498A case; remedies are independent. Practically, filing after delay is legally maintainable but evidentially vulnerable. A poorly timed or weakly pleaded complaint risks quashing under Section 482 CrPC. Possible, but proceed only with clear facts, continuity, and legal strategy, not emotion

Yes, you can file a dowry harassment case even after one year of filing a case under the Domestic Violence Act. Filing DV maintenance etc. does not bar you from initiating another case if the facts disclose a separate or continuing offence. However, drafting need to be done with cautious as courts scrutinize delayed complaints carefully.

Yes, you can still file a dowry case (498A IPC / relevant sections) even after 1 year of filing DV Act and maintenance case. There is no strict time limit for dowry harassment cases as long as the cruelty or demand is connected to marriage. Filing DV and maintenance does not stop you from filing dowry case. However, delay can be questioned, so you should explain the reason for delay properly in your complaint.

Yes you can file a case for dowry after one tear of filing of Domestic violence case and maintainance case, but you need to make sure that the evidence you provide for making a claim must be credible, so that your claim won’t get rejected. Though you can also include the same claim in one of your cases for instance in divorce/maintainance as the family court may grant you mutliple reliefs in a single case.
