Can i apply maintenance from husband if not living together from 2year

I am living with my parents for last 2 years .Becoz some conditions I was not able to file my case till date now some lawyers advice me the is not strong as it has been delayed. I am working in a private school has a two year old daughter .My all assets except some jewellery are with my in-laws.I was mentally harrasesd by my husband and in laws for more dowry inspire of fact my father has given everything they have asked in the marriage.we were told that my husband is M.C.A after marriage I get to know he has not completed his studies.I was tortured by my mother in law for various things money ,a girl child ,family background and all .my husband keep asking for money even for his mobile recharges.i have spent even for doctors fees n all checkups during my pregnancy. After the birth of my daughter the condition become worse .I was forced to left with my brother .Now i hv lost my father so I am all alone with this .Now I am responsible for financially and other responsibilities .

Very first you tell in which district you reside? You have been mentally tortured by husband and in laws as you told you may file a complaint against them before competent court,U/S-498A,and other applicable sections as well as a case before family court U/S-125crpc as well as a case U/S-25hindu marriage act if you Hindu.you may explain delay so you are not late.

आप बिल्कुल अभी भी अपने एवं अपनी बच्ची के लिए भरण-पोषण के लिए अपने पति के विरुद्ध केस दायर कर सकतीं हैं ।भले ही आप जाॅब ही क्यों ना करतीं हो, आप तब भी अपने पति से भरण-पोषण पाने की हकदार हैं ।
इस बात से कोई फर्क नहीं पड़ता कि आप कितने समय से अपने पति से अलग रह रहीं हैं और ना ही इस बात का फर्क पड़ेगा कि अब तक आपने केस दायर क्यों नहीं किया ।

Hello, don't delay in file a suit because waste of time is not good for u. First u lodged a FIR and don't be hesitate in court. Also file a case of domestic violence. Made a certificate of medical and show that in court.
