Can I Apply for divorce seperately.

He has files for divorce few yrs back but did not continue the proceding.( I was not interested too) Now I don't know where he is and I want to apply for divorce on the basis of desertion. How to go about it?

hello in your problem you said that husband filed petition for Divorce and this case is pending before the court but now it is not continue from your both site. now your question is that you also want divorce . Now you have not need to file another case for Divorce because divorce case is already pending in the code. Like this situation you contact your husband and said them that for continue the same case in the court. you have to present in this case with your best family lawyer .Submit the application for mutual divorce in this pending case .when granted the amendment for mutual divorce .you not necessary file the separate petition for divorce. thank you

hi you can proceed for divorce in this case you have to mention last known address of him in the petitions you can also file domestic violence proceedings. you can claim maintenance and other matrimonial rights

You may first check the status of the divorce case filed by your husband and if it is already dismissed by court due to non- presence of parties then while filing new petition , you can give reference of that case. You can file for divorce on desertion in the concerned court.
