Can court cease bank account of relatives in Divorce proceedings
04-Oct-2023 (In Divorce Law)
Does court cease joint (joint account of Sister in law & Husband)account also if husband not able to give maintinance to wife? (2) Can we go to highcourt for ex-party case of domestic violance? I am from husband's side.
Firstly be clear that about the why the account is ceassd what cause was mentioNed it is not easly to say without going to actual facts yes court hai full power to cease any account in respect of maintenance and all but further you may reach high in a writ ..
Yes, court can proceed to cease the joint account of husband and sister-in-law in case of non-compliance of the order of maintenance. Since the husband holds equal authority over the bank account, the mere fact of its being a joint account will not have much effect. However, the seizure is a process of much later stage.
Higher court can be approached against an ex-parte order, in case the order under challenge was passed without giving proper opportunity to the husband for hearing.
