Can a separation be granted under mental torture after 28 years?
05-Sep-2023 (In Divorce Law)
A bad marriage need not necessarily be violent. Constant criticism amounting to emotional torture and constant arguing between couples leads to setting unhealthy and dangerous examples in the neighborhood and society. Can a separation be granted on those grounds after 28 years of marriage without undue hassles please?
mental cruelty is one of the ground for judicial separation as well as divorce also, are you have children or not , if you have children burden lies on you to maintain your children , the said children is below 5 years you have to pay maintenance both children and your wife.
Dear,
Yes. Judicial separation can be granted as the ground/reasons you have mentioned amounts to cruelty. You have to file a petition for a decree for judicial separation in the jurisdictional family court. Judicial separation is a kind of a last resort before the actual legal break up of marriage i.e. divorce. Once a decree for judicial separation is passed, a husband or a wife, whosoever has approached the court, is under no obligation to live with his/her spouse.

HI
Yes. emotional torture and constant bickering/ arguments between couples can be good grounds of divorce as both parties have irreconcilable differences but having been leading a married life for 28 years under false pretexts.
