Can a major child claim maintenance for study after mutual divorce

16-Apr-2024 (In Divorce Law)
Hi, I got mutual divorce in Apr'2018 from my wife. At the time of divorce, I paid 1 time settlement/alimony towards my wife and minor child (son). It is mentioned in my judgement that "all the past, present and future claims of settlement etc. have been settle between parties (husband and wife)." My son is 18+ years old now and my question is can he claim maintenance for study or anything else from me or my father.

No, he can't claim any maintenence after getting 18+, you son has no right to claim any maintenence at that stage, for more enquiry u can contact me, but he can claim the rights in property if there is any.

Being his legal heir, he can claim share in the ancestral property of the father. Divorce between parents does not change the father. He will always have the right in ancestral property (property in his name other than self acquired property).

Yes, a major son can claim maintenance after a mutual divorce if he is still pursuing his education and is not financially independent. As per HMA A child who is pursuing their education is entitled to maintenance even after they attain the age of majority. You can Contact me over phone call or whats app for further Assistance.
