Wife catholic and husband Hindu. First marriage was as per Hindu rituals and second marriage as per catholic rituals, husband has the proofs for Hindu marriage and wife has catholic marriage proofs. Can a divorce be filed under the Hindu marriage act?
In case of non conversion, it is better to not file the divorce under Hindu Marriage Act as the court could object your religion and hence the petition.
Secondly, you do not have pictures to show to the Court that you married according to Hindu rituals so better not to go for Hindu Marriage Act.
Well, the Husband must file a Divorce Case as per the Act in which his Marriage got registered. If the marriage of the Husband got registered as per the Hindu Marriage Act by the Registrar of Marriages, then, he must apply for the Divorce either Mutual or Contested one as per the provisions of the Hindu Marriage Act, 1955. If no Marriage Registration was done before the Marriage Registrar, then, the Wife may create complications, if she does not agree to Divorce Husband as per the provisions of the Hindu Marriage Act, 1955.
