Dear client, In the pursuance of your query, I do hereby reply for the same in the following manner. That yes you can file a case for mental harassment against your husband. Although there already a divorce case pending in the court of Law. However this fact will not hamper in any way rather it will help in your mental harassment complaint. Note:- this is normal advise as you have provide very less facts. To file a case in DV act I need to know more about the facts. For further assistance you can contact me. As long as you are sharing the same household with your husband d and whilst your stay with him, he maltreatment you, in that event, you have every right to file dv complaint, notwithstanding the fact, that you have filed divorce or not. Go ahead, raise your voice, file a complaint. But if you are living separately with him than you cannot file dv complaint.
