Can a court issue exparte order of maintenance without serving

Hi, Suppose wife leaves the husband house and husband changes the house he has been residing earlier and does not convey the new address to the wife , can the court issue exparte maintenance order or LOC against the husband with the notice being served to him properly?

Hi, the court has to show that the notice was served to you. It will not be only done by physically sending the notice on your address. It can be served you through email or whatsapp as well or any other electronic mode.

Yes court will definitely issue an ex karte and will also take into your behaviour of hiding your address from the court. they can even issue arrest warrant if the need arise . better contest the case and reduce the maintenance amount or get if altogether quashed if they are grounds in your favour

There are many ways to summon the husband ! U need go hire expert advocate in this regard and not otherwise ! A proper suit needs to be filed with all the available addresses, WhatsApp nos, email etc Kindly n in touch
