Calculation of permanent alimony amount

16-Oct-2023 (In Divorce Law)
My wife, along with our 3.5 years old baby girl, left her matrimonial house 1.5 years & not returned back. Last week all of a sudden she appeared before my office superiors and lodged a written complaint of physical & mental torture by me and seek maintenance from my my office. This particular act is a mental cruelty to me. I want to divorce her immediatelyI draw a salary of around 50k per month. I have a bank balance of around 2 lakhs. I have no other fixed asset as well as financial asset in my name. If I file a divorce petition, then how much amount of permanent alimony she may get?

as per the apex court you are supossed to pay her 25 per cent of gross salary as alimony, it is not a good decision on your part to file divorce and get yourself trapped better file a case to bring her back even if court orders you are not bound by it, its a total mind game to lower the maintenance and frustate her

try to first prove that your wife has deserted you without any fault of yours. that would tilt the balance in your favour in providing any maintenance to her. unless it's a divorce by mutual consent it takes awhile so there's no immediate divorce except immediate filing for divorce. in deciding permanent alimony please remember there is no straight jacket figure but the court arrives at this value taking a holistic view of attending circumstances particularly your net worth. if I'm to make a very wild guess then given your wife is in her 20s and unemployed she might get something around 10 lakhs.
