Bring son home after sending notice
26-Nov-2023 (In Divorce Law)
My wife left me before 9 months. I sent a notice for mutual divorce and she asking for lifetime maintenance. I went to meet my son and my father in law did not allow me to meet. Said that reply to notice. Case in not filed yet. What will happen if I forcefully enter their house to meet my son? Can I forcefully bring him to my home as there is no court case yet.
how old is your son? Have you filed divorce case yet? first need to understand your sÃtuation fully and then I can give my opinion, being father you too have custodial rights. you have legal remedies too.
first of all you can file criminal application for the custody of child as because of unlawful detention also you can file permanent custody of child guardians act you can also go mutual terms for the custodial right in the divorce petition.
It is not advisable to forcefully enter anyone's house. forcefully obtained custody is not acceptable in law, nor courts allow it. You can reply to the notice. or file for the divorce.
