If there are serious allegations and the other side is not appearing in counselling sessions, then the same would be dismissed and appropriate action as per law would be taken against him. Mutual divorce is an amicable settlement and can’t be forced upon any party. If you have legal grounds, you may proceed for one sided divorce. For any further query feel free to contact. Thanks

settlement or counselling both are different things. what is your case that you have not stated. counselling is when you have to talk things over and understand it to continue with your life. settlement comes mostly in cases where you are ending your relations.

If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

You have to proceed properly, taking all the possible legal steps. If your husband is not coming for a conciliation, you may choose to take coercive steps. it will need to be seen what offences have been committed and draft a proper complaint which may be later converted to an FIR.

As the boy is residing outside India so he cannot be arrested even if the FIR is lodged against him. But you can surely file Domestic Violence and maintenance case in India but again it can only be executed if he resides in India or has some property situated in India. Though we always advise for mutual divorce in such cases but you can file contested divorce as well but there are certain implications in the same. For more and proper legal consultation please feel to contact for further queries as we would require more details in order to advise you better.
