Boy Child custody who will get if i go to court how to start process.

My wife has gone to her maternal home when she was 6 month's pregnant. It is now almost a one and half year that she has not returned home. My son is about 10 months old now. Now I came to know that she is planning to go for higher studies to UK by keeping baby with there parents..nNow what should I do.nHow yo start it ?nI will get the custody of child in this case if I goto court?

ಸ್ince you are the natural guardian of the child your wife you cannot leave the child with her parents and dinner your custody while leaving the country therefore you can now file for custody of the child.

Yes, you can get the custody of your son. There are two ways to get the custody, first is by filing GWOP and second is filing a writ petition in the High Court. There are chances where your wife can also be stopped from going abroad.

Yes you can stop her not going abroad and u can file a guardianship petition and make ur kid to stay with u and if u want to live with her u can file RCR petition...and make her to stay with u and any updates let me know
