Been 7 months since my friend got married what procedure for divroce
28-Sep-2023 (In Divorce Law)
his wife is having an affair from many years and he has all pics and call recordings as proof. She has misbehaved a lot with his family. Now as she has left/ been sent home, she is threatening his family that she will not let him get divorce so easy and will report physical torture etc. Please suggest how to get divorce at earliest and what are the possibilities or circumstances under which she can blame him wrongly or make him suffer along with the way outs. Religion is Hindu.
As per Hindu law no marriage may be dissolved unless period of one year has elapsed since solemnisation of the marriage ,though in the case of exceptional hardship it may be dissolved earlier ,this provision was made so that young couple could understand each other and get matured in their relationship ,since your friend marriage is only seven months old it has be proved that it comes under exceptional grounds viz:1.Hardship 2.Depravity on the part of respondent .

Before marriage affair no ground for divorce. If after marriage wife in adultery than you can file divorce case aggnest wife on ground of adultery and give all proof in Court who show wife are living in adultery.

Past relationships can not be a ground for divorce but may be helpful to prove character. Threats by her will also be a ground as a cruelty by wife against husband. To be on the safe side you may file suit for restitution of conjugal rights. Alternatively you may file divorce petition but it will not be entertained before lapse of one year of marriage. In fact you must consult lawyer with complete facts.
