My wife is threatening as she files 498a, I dont have anyone to give surety also not much amount... so If I need bail is it possible to take on personal bond, by signing on body guarantee for this case
case under Section 498A of the Indian Penal Code, which is a non-bailable offense, bail is at the discretion of the court, not an automatic right. While you cannot demand release solely on a personal bond without a surety as a right, the court may, under certain circumstances, allow for a personal bond or cash security in lieu of a third-party guarantor.
Dear Sir,
Anticipatory Bail (Section 438 CrPC):
If you apprehend arrest, you should immediately apply for anticipatory bail.
Courts routinely grant anticipatory bail on execution of a personal bond, especially where:
The accused is cooperating with investigation
No prior criminal antecedents
No serious injury or dowry death allegations
bail on personal bond without surety is legally permissible in a 498A case, and courts frequently grant it, particularly in matrimonial disputes. But, Bangalore Courts insist for Caste Security or Surety of Third Person who is having property or a Government Servant.
