I and my bf did arya samaj marriage 3 years ago and did not registered it in court. Now we are not in relation anymore. How can we collapse this marriage. He is saying that we need to file a divource, but if the thing is not registered into court, why there is need to end it in court. Please help me to discontinue this arya samaj marriage
If you belong to Hindu religion then you cannot dissolve this marriage out of court, such marriages have to be dissolved via Hindu Marriage Act 1955, therefore without filing divorce petition u can’t take divorce !

A marriage solemnised in Arya Samaj Mandir is a valid marriage and to discontinue it, you have to file divorce petition in the court. Both of you have to file a joint mutual divorce petition in order to take divorce in the family court of your territorial jurisdiction. You may consult me in that regard.

If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. He is right. The marriage certificate issued by Arya Samaj is sufficient proof of marriage being solomonized hence it needs to be either annulled or come to an end through divorce. Either of the two could be performed by court. Registration of the marriage is compulsory but non Registration of marriage is not a ground claim that marriage was not solomonized.

Marriage done at Arya Samaj Mandir is a valid marriage in eyes of law and a valid marriage can only be dissolved by the permission of court, irrespective of whether it is registered or unregistered. If any of you proceed with another marriage without dissolving this marriage, the second marriage will be invalid in the eyes of law. However by a mutually agreed agreement you can also have an alternative of dissolution of marriage.

as per the hindu law, If the marriage is solemnised whether registered or not , the separation can be possible only by Hindu Divorce Act...otherwise there are no rules of formal separation..informally you can stay separated as long as you want
