A Section 9 case refers to proceedings under Section 9 of the Hindu Marriage Act, 1955, where a spouse petitions the district court for restitution of conjugal rights. If one spouse has withdrawn from the society of the other without reasonable cause, the aggrieved spouse can seek a court order directing the other to return to the matrimonial home. The burden of proving a "reasonable excuse" for leaving lies on the spouse who has withdrawn. If granted, the decree essentially directs cohabitation, though it cannot be enforced by force only through legal consequences such as being a ground for divorce if not complied with.

You can successfully go for filing of a section 9 application before the court. That will serve as a solid proof of the fact that you are calling her and she’s not coming back to join the matrimonial home. For more legal assistance I am just a call away .

We would advise you to seek a detailed consultation from a lawyer having expertise into matrimonial laws. You need to brief the lawyer and provide the relevant documents to enable a lawyer to formulate a strategy and opine upon the same.

You may file Section 9, but try mediation first. If she refuses or makes false claims, it strengthens your defence. Show genuine intent to reconcile and preserve all evidence.
