Applying foreign divorce decree to get Indian certificate

12-Sep-2026 (In Divorce Law)
marriage registered in both India & foreign. “Uncontested” divorce on grounds of “irreconcilable differences”. Signed settlement agreement says they submit to foreign jurisdiction & decree will dissolve Indian marriage too. Divorce decree granted by foreign court. Now one wants an Indian court’s declaration, certificate or decree, after many years. Can he get one? Do they have to file financial disclosures at all, and if so, even for all years after foreign-divorce? What’s the procedure?

Foreign decree is applicable in India as well. Still you want to file a Mutual Divorce Petition then you have to show your residence proof in India and then you can file a petition before the competent court of law. Further you have to prepare the separate settlement Agreement for this.

Hi there, firstly the foreign divorce decree is not automatically applicable in India. We'll have to scrutinise it for the validity based on factors like grounds of divorce in India, jurisdiction, etc. If the decree passes the aforementioned test then all you need to do is file for declaration suit and present some connecting evidences and the decree will be valid in India as well and your marriage will dissolve here as well. In order to provide you with the appropriate advice I'll need additional details. Therefore, it's advisable to contact me and provide requisite details to assist you better.

A foreign divorce decree is not automatically binding in India. Its recognition depends on Section 13 CPC and the principles laid down in Y. Narasimha Rao v. Y. Venkata Lakshmi. The foreign court must have proper jurisdiction and the ground of divorce must be recognised under the applicable Indian law. An appropriate declaration/recognition proceeding can be filed before the competent Indian Family/Civil Court. Financial disclosure is not automatically required for every year after the foreign divorce; it depends on whether any surviving claim for maintenance, alimony, property, etc. is involved.

The complete foreign divorce petition, settlement agreement and final decree must first be examined. If both parties voluntarily participated, accepted the foreign court’s jurisdiction and consented to the divorce, the foreign decree can generally be recognised as valid in India. A separate Indian divorce decree is normally not required. However, if any authority refuses to recognise it, an application for declaration can be filed before the competent Family Court. No financial disclosure is ordinarily required if maintenance, alimony or other financial relief is not being claimed. Financial details for all the years after the foreign divorce are also not required. Since the divorce was granted many years ago, the dates and reason for seeking the declaration must also be examined because a limitation objection may arise.

Sir/ Madam! Any agreement doesn't dissolve the divorce in India automatically. Any such condition put in the agreement that the foreign decree granting the divorce will automatically dissolve the Indian marriage will be considered void ab initio. Please note that only the concerned family court of India has the power to rescind a marriage and even the foreign decree granting a divorce is unforceable in India. To your question if you can get a decree from Indian Court and whether you will have to disclose the financials, the answer is yes, you can file mutual divorce in a family court of your concerned jurisdiction and there is absolutely no need for you to declare any financials in that if you opt for filing the petitions seeking dissolution of marriage by way of mutual concent. As far as the time of filing the mutual divorce petition, there are no limitations to it and you can file it even after a passage of several years of being granted that foreign divorce decree.
