Applied for mutual divorce gave POA to me can I sign on her behalf

My daughter is applying for divorce by mutual consent, She is currently in USA. She is unable to attend personally due to visa issues. she has given a power of attorney to me. can i sign the petetion on her behalf.

Ans: normally in family court personal attendance of the parties are required, therefore, court may not accept the POA to negotiate, or mediate the matter before the Mediation center. it would be better if she personally attends

Sir, matrimonial cases are of personal nature and your daughter will be required to sign on a few, if not all the documents herself. A power of attorney has certain restrictions.

In addition, every State has its own rules. Please contact the enquiry counter of the court in which you will be filing the Petition.
