Anxiety issue divorce case. Need husband

Husband filed a divorce petition saying wife having anxiety issue 5 years still case pending wife is not ready to give divorce. She says she is healthy. And wife case section 9 had dismissed or cancelled. .what will happen in this suction. Either husband should produce the evidence of wife health issue. Or court ask anything to wife

Husband should prove wife anxiety issue before the court by producing relevant documents. Or husband can seek the court for medical examination of wife, this can be only in exceptional cases not in every case.

see since the section 9 has been dismissed by the court it proves that there is irretrievable breakdown of marriage Since husband has filed the case on medical grounds you have to prove in the court that wife is healthy and in order to retaliate the case you have to file an objection to his petition on grounds as prescribed under section 131a(i) of hindu marriage Act 1955

Dear Sir, For early disposal of your case you may approach High Court by filing a Writ Petition. You may get Divorce since her application under Section 9 of Hindu Marriage Act was dismissed. The husband should not neglect to bring the issues of cruelty rather than health issues of the wife to get Divorce. The Court is neutral as such it never asks anything to the wife.
