Annulment case by wife -Impotency/Non Consummation against husband

Wife has put false blame of impotency If both parties agree that marriage is non-consummated but put blame on each other. And if husband is also proved Potent after test. What would be the outcome of Annulment case , 1-)will Annulment t be given (as both parties agree for non-consum. but no defect was medically proved in Test). 2-) Or The case will be dismissed 3-) How often does order test, Can/Will court also ask girl to undergo some kind of test Shall it be requested byhusband ?AnyStrategy?

1) she will lose the case if you are proved potent by a competent medical authority. 2) already answered above 3) yes either party can allege and get his/her contention proved at his/her costs actually you have to discuss your case at length. only then the appropriate solution can be dug out

Please clarify whether your wife has filed divorce petition on the ground of impotency. What was the reason for agreement of non consummation of marriage. If after medical examination it comes out that you were not impotent, there is a possibility that her divorce petition is dismissed and you can sue your wife for defamation. Insist for medical examination of wife only if you are sure about it otherwise don’t request the court for her medical examination.
