Am I eligible for divorce? I am not sure please help

Hi my husband doesn’t love me anymore. He talks to me rudely. I don’t ask him for anything these days because I’m scared he’ll get angry and shout at me. I am unhappy in this marriage. We’ve been living with his parents since we got married. I am not happy with that. I have told him I am not happy and want to live separately but he refuses to listen. We hardly talk to each other these days. I don’t want to live with him or his parents anymore. Can I file for a divorce? On what grounds?

You can talk to your spouse of seeking divorce if not then you have to file a petition against your husband for obtaining divorce. there are numerous grounds on which you can file for divorce depending upon the facts and circumstances of your matter.

You can definitely file for divorce. Based on what you have stated here about your husband, he has committed cruelty against you and cruelty is a good ground of divorce. You can file a petition for divorce before the family court. However, divorce should be the last option. Try to sort out the differences between you both. If not possible, you have to file for divorce.

Well, you can file to seek a Unilateral Divorce if being a Hindu, you want to seek Unilateral Divorce in India. Under the Hindu Marriage Act, 1955, one sided divorce can be filed on grounds such as cruelty, adultery, desertion, conversion, mental illness, communicable diseases, presumption of death, and renunciation of the world.

you can file for divorce on Grounds of cruelty you can also mediate with your husband or negotiate with your husband to opt for mutual divorce mutual divorce is less time consuming and avoids Lengthy litigation
