Alimony related issue to wife , can i get it back from her

At the first motion of mutual divorce, I had given half of the alimony amount to my wife, But now I do not want to go for the second motion, can I get the given amount back from wife.

hello client as i can see your isaue ia vwey important aa you do not wnat divorce drom your wife . in this matter yes it is possible but it can only be done through the help of the court we can do it

You can make an application for return of your alimony amount given in the first motion but it entirely depends on the discretion of the judge to entertain the same ideally alimony given in the first motion or any sort of amount given in the first motion of mutual consent divorce is not returned but in special circumstances the court may allow at the behest of the other party thank you

in case you do not go for second motion you have to options 1. file recovery suite who to get back the amount already paid. 2. file divorce petition, any amount already paid will then be adjusted with any future liabilities that arise in favour of your wife.

Need more facts on it …! What has been mentioned in your settlement deed is the main crux ..if u have written in the settlement deed that if any party doesn’t go or execute second motion then other party shall refund the amount etc …it totally depends on the terms ..b in touch
