Alimony or Maintenance issues in India

Dear Sir,nDo the hindu husband needs to pay both alimony and per month maintenance to his wife? nIf either of them needs to be paid then who gets to decide (husband or wife) whether the money should be paid in lump sum or monthly basis?

The lump sum alimony can be decided on the mutual understanding of both the parties and is usually settled where the mutual divorce arises. As far as the per month maintenance is concerned it is usually available to the wife from the court as ad-interim maintenance. For more legal assistance I am just a call away.

hello cliets as a matter of law in india in matronial cases the alimony can be decided either in lum sum amount or in per month basis it depends on the way if settlements is going to happen in the court for the litigants same has to be follweed as a matter of law either of the ootion is requires to be opted.

Hello Sir, Every thing depends on the facts. if the wife is ready to give away any ot both of them, you can file divorce by mutual consent but if you go to court to contest, then only court gets to decide.

It’s depends ! If u win the case u might not have to pay anything at all ..otherwise court can ask to pay alimony on divorce and Maintenence in DV OR 125 U need to hire expert advocate in this regard Be in touch
