Alimony demand delaying grant of divorce

28-Nov-2023 (In Divorce Law)
Hi, My wife has filed for divorce on false grounds of cruelty which I am contesting. She is demanding crores of alimony when I don’t even owe her a single penny and she is financially independent and earning pretty handsome salary. I have been fighting the battle in court since 3 years now and there is no end in sight. I want divorce asap and my wife and her family are saying that they will not budge till I give them money. She does not want to move on in life and is using signature divorce paper as ransom to get divorce. It is clear that both parties want divorce and it’s just a question of alimony. 1. Can I plea to court to grant divorce as both parties want it and alimony can be decided in parallel.

Dear Sir, Due to arrogant nature of your wife many judges decline to pass any orders and go on adjurning the case. As per the circulars is to be disposed within 1 year. You may approach High Court by filing Writ Petition and get a direction to the Family Court to dispose your case within next 3 months. Then the High Court will pass orders fixing the alimony as per settled law taking into consideration of contentions of both of you.

Let this concept be very clear. Firstly the divorce matter is still pending with all false allegations right. Let us try to cross examine her and elicit the truth. As such you can lead to disposal of the case. And yes we can also file a petition for counselling by the courts for any amicable settlement. Last resort is that we can approach high court by certain grounds to obtain early disposal of the matter.
