After RCR what is the next step to get divorce
20-Nov-2023 (In Divorce Law)
Hi
I got ex-parte RCR order from Mar 2017.
My wife not responded till now
I'm trying to file divorce case but my advocate told me I need to wait 2 years after order.
Is it require to wait 2 years after RCR order?
it depends on case to case by if you are doing to file divorce on ground of desertion then it is mandatory period to wait for 2 years but it is not from the period of RCR it counts from the period when your wife left the conjugal society
Firstly, RCR is not mandatory you can straightaway file for divorce. In your case you have merit as she didn't responded to your RCR that itself is a ground for divorce that she is not willing to join you. You don't have to wait for a single day. Don't loose this opportunity as your wife may prefer an appeal to set aside exparte order.
