You are currently in a strong legal position. The trial court has already dismissed your wife's 2024 petition to reopen the case, explicitly stating that her reasons were false and wrong. Since the original DV Act case was dismissed in 2022 due to her continuous absence, it indicated her lack of diligence in pursuing the matter. Her subsequent challenge to the dismissal order in the Sessions Court is a statutory remedy (an appeal or revision), but it is important to remember that the Sessions Court will primarily examine whether the trial court committed a legal error or perversity in its decision. It will not easily overturn a well-reasoned dismissal based on proven lack of diligence. For your strategy, you must now actively contest her appeal. You should file a detailed counter-objection or reply, highlighting her conduct of remaining absent for years and reiterating that her current plea is an abuse of the legal process. It is crucial that you and your family members engage a competent defense counsel to argue that the trial court's findings were justified and based on evidence. You should also request the Sessions Court to impose heavy costs on her for filing frivolous litigation. While the Sessions Court may temporarily delay the finality of the 2022 dismissal, your defense is strong because the burden of proof lies on her to demonstrate why the earlier dismissal should be overturned. Continue to appear diligently in court for all hearings, file your written submissions promptly, and seek an expedited hearing to prevent unnecessary protraction of the case. Ultimately, the legal scales currently favor you, provided you rigorously defend the trial court's sound judgment against her appeal.

You have a very strong case in your favour. 1. Dismissal for Default: Your wife's DV Case U/S 12 of Protection of Women from Domestic Violence Act, 2005 was dismissed in 2022 due to her regular absence. This shows she was not interested in pursuing the case. 2. Restoration Application: As per law, an application for restoration must be filed within 30 days with a sufficient and genuine reason for absence. Since she filed for reopening in 2024 i.e. after 2 years, it is highly time-barred. The Ld. Trial Court has rightly dismissed her restoration plea by holding the reasons as wrong and false. 3. Session Court Appeal: Now she has challenged the order in Sessions Court U/S 29 of DV Act. You need to do the following: a) Appear in Sessions Court through your lawyer and file a strong objection/reply. b) Argue that the restoration is barred by limitation and no sufficient cause is shown. c) Highlight that the original case was dismissed due to her own negligence after 5 years. d) Also bring to the court's notice that she is misusing the process of law. The Sessions Court generally does not interfere with a well-reasoned dismissal order of the trial court when there is a huge delay and false grounds. You have good chances of success. You should contest the appeal strongly and also keep the certified copies of the 2022 dismissal order and 2024 dismissal order ready.

Aap bilkul mat ghabraiye, aapka case kafi strong hai kyuki lower court ne unki absence aur jhoote allegations ki wajah se restoration petition pehle hi kharij (dismiss) kar di hai. Sessions court ki is nayi appeal ko kharij karwane ke liye aapko sahi tarike se apni baat rakhni hogi. Case ki aage ki strategy taiyar karne ke liye aap turant Advocate Sudesh ke sath ek appointment consultation book karein, taaki aapke case ki files ko check karke ek solid legal defense banaya ja sake.
