Advice for divorce and second marriage

I filed divorce case on my husband in December 2016...till now it is not done..my husband is just passing the time not attending the dates...changing the advocates...I have a 12 year old son ...I like another person since one year and we want to marry....my husband is drinker...he did domestic violence on me so many times...he doesn't earn and spend a single rupee on the family...case is not solving since long ...it's too time taking...can I marry in this case without finalizing the divorce..

no you can't marry unless and until your divorce is finalized. asked your lawyer to appear on each and every date and request the court for taking action against him for not appearing and for unnecessary delaying the case.
you also have an option for moving a petition in high court for expidite hearing of the case and the high will direct the family court for deciding the case within certain time frame.

Dear mam

According to law you can not marry to another person without divorce decree. If you want to marry some one then get divorce. and for early decision, expite your case for file a writ of mandmus before High Court .and your case of divorce decided soon.
