Abuse Threat and Blackmailing from Wife what to do

09-Jul-2023 (In Divorce Law)
Hindu Marriage. My wife ( this is her second marriage) and her( from her first husband) constantly abusing me, blackmailing me of committing suicide, do not open the door when I back from work late evenings( after 10pm) inspite of being awake, being rude to my parents(senior citizens), made an attempt to disrupt their 43 household and throw away their things and humiliated and acted leading to defaming them in the society. Constant asking money. Hardly ever cooks for me and says she married me as caretaker for her daughter, she doesn't love me or need me. Making my life hell and constantly nagging and shouting, abusing and fighting with me. She is rich, infact richer than me, having land, property, bank balance, FDs, gold etc. Still wants my money. Point to be highlighted, she was ousted out from previous matrimonial home, ex husband committed suicide, ex inlaws threw her out of the house after 10th day of funeral and didnt even accept the child as their granddaughter.

If you think she is coming your way then go for Mutual Divorce. For Mutual Divorce she may not agree as she wants a husband for society. Then no option left out rather than applying for Divorce. Seems to be her nature is deceptive, be cautious.

Dear Sir,

Domestic violence can be defined under four broad categories- Physical Abuse, Sexual Abuse, Verbal and Emotional Abuse and Economic Abuse. In this Act, physical abuse means – causing bodily harm, danger to life, limb or health or development of the aggrieved person. This includes assault, criminal intimidation
and criminal force.

It is important to have a look on the results of Suicide, Depression and Divorce in
the Indian society. A survey conducted by the National Family Health Survey
which throws light on unprovoked violence against men by women is evidence in
this reference. Notwithstanding the fact that double the numbers of men commit
suicide as compared to women. It should not be a surprise to go for a law to protect
men as such a law for women already exists. In fact, it would be preposterous in
this age of gender equality, not to have such a law. Such a law to protect men from
domestic violence would act as preventive relief to millions of those men who feel
victimized and left out. It would also provide them with a legal platform to come
forward and share their pain and get some semblance of relief. The Supreme Court
has said in a recent order that IPC Section 498A has “dubious place of pride
amongst the provisions that are used as a weapon rather than a shield by
disgruntled wives.”

Yes, You can file a case against your wife but abuse has to be proven . Police reports, ER or Dr. reports. Photos of injuries, restraining orders and or reports of missing work. If you are a male victim, get your documents in order and seek help.

OR

"Men can however seek divorce and file a case of cruelty against the wife." Consult Family Legal lawyer.
